Electrocution Accidents

Electrocution Accident Attorney in Atlanta

Direct Attorney Access for Electrical Injury Claims

An electrical injury at work can raise two separate legal issues: eligibility for Georgia workers’ compensation benefits and whether someone other than the employer contributed to the accident. At Kaleita Law Firm, LLC, Attorney Douglas F. Kaleita personally works with every client to evaluate both possibilities. We represent injured workers and families in Atlanta and Sandy Springs.

Electric shock can cause severe burns, heart damage, and nerve damage. Severe cases can also lead to brain injuries or amputations. A fatal workplace electrocution may leave a family facing lost income and wrongful death questions. Our work spans workers’ compensation and catastrophic injury claims, as well as product liability, premises liability, and wrongful death cases. We draw on local roots dating to 1991 and 35+ years of experience. Douglas F. Kaleita was selected to Super Lawyers from 2023 through 2026.

Common Causes of Workplace Electrocution

Electrical accidents often arise when energized systems aren’t properly isolated, maintained, or controlled. Construction sites and industrial settings can present added hazards when machinery and multiple contractors operate near live electrical systems.

The circumstances may raise questions about whether a contractor, utility company, equipment manufacturer, or property owner contributed to the incident.

Electrical injuries may involve:

  • Direct contact: A worker touches exposed wiring, an energized component, or a damaged electrical tool.
  • Power-line contact: Equipment or materials come into contact with overhead or underground electrical lines.
  • Defective equipment: A tool or machine fails because of faulty components, damaged insulation, or another electrical defect.
  • Unsafe worksite conditions: Inadequate grounding or uncontrolled electrical hazards expose workers to current.

An electric shock doesn’t need to leave a large external burn to cause serious harm. Electrical current can damage internal organs, muscles, nerves, and the heart, making prompt medical evaluation important after an incident.

Georgia Workers’ Compensation After an Electrical Injury

Georgia workers’ compensation is generally a no-fault system, so an employee usually doesn’t have to prove employer negligence to pursue available benefits. Employers with three or more employees are generally required to carry workers’ compensation insurance. Benefits may address authorized care and part of the wages lost while an injury prevents the employee from working.

Deadlines begin soon after an accident. An injured employee generally must report the injury to the employer within 30 days. Form WC-14 generally must be filed within one year to preserve a claim, although employer-provided care, weekly benefit payments, and other statutory circumstances can affect that deadline under O.C.G.A. § 34-9-82.

Choosing a Treating Physician

Georgia law generally directs an injured employee to choose a treating physician from the employer’s posted panel, which lists approved providers. If the employer hasn’t maintained a valid panel, the employee may have the right to select a physician. The panel’s validity and the circumstances of care should be reviewed before assuming a particular doctor is required.

Benefits for Disabling & Catastrophic Injuries

Temporary Total Disability benefits replace part of an employee’s wages while an accepted injury prevents work. These benefits are generally limited to 400 weeks for a non-catastrophic injury. A catastrophic injury designation is a legal classification for certain especially serious conditions. Depending on the facts and applicable law, that designation may qualify a worker for lifetime medical benefits.

The Georgia State Board of Workers’ Compensation administers these claims. We review records before filing, track applicable deadlines, negotiate with insurers, and represent clients in appeals before the Board when needed.

Claims Against Negligent Non-Employers After an Atlanta Electrocution

Workers’ compensation generally prevents an employee from suing the employer directly for a workplace injury. It doesn’t necessarily prevent a claim against a negligent non-employer. A separate liability claim may be available when a contractor, utility company, equipment manufacturer, property owner, or another outside party contributed to the electrical accident.

The two types of claims provide different forms of compensation. Workers’ compensation benefits can cover authorized medical care and partial wage replacement. A liability claim against an outside party may seek damages that workers’ compensation doesn’t provide, including pain and suffering, subject to the evidence and available insurance or assets.

Georgia’s general personal injury statute of limitations is two years from the injury date under O.C.G.A. § 9-3-33. Under Georgia’s comparative fault statute, O.C.G.A. § 51-12-33, an injured person who’s less than 50% at fault may still recover damages, with the recovery reduced according to the assigned share of fault. Different notice rules or deadlines may apply in some cases, so early evaluation helps identify which requirements govern.

When a negligent non-employer contributes to a fatal workplace electrocution, Georgia law may also permit a wrongful death action. We examine whether the facts support a workers’ compensation claim, a separate liability claim, or both without treating one path as a substitute for the other.

  • We Know When to Fight
When working to collect benefits or negotiate a settlement for a client, we are not here for our egos.  We work to attain success without long, drawn-out battles. No one benefits from endless fighting instead of resolving issues.  There is an old saying that “Justice delayed is justice denied.”
  • You Only Pay When We Win
Attorney’s fees in Workers’ Compensation are “contingency fees,” which means we only get paid for our services when we recover benefits for our clients or settle their claims. You only pay when we win for you.

Hear From Our Happy Clients

How We Prepare Electrical Injury Claims

We begin with a free case evaluation focused on how the electrical incident occurred, the worker’s condition, and the available sources of compensation. Attorney Douglas F. Kaleita remains directly involved throughout the case. Our firm has recovered millions of dollars for wrongfully injured clients, although every claim depends on its own facts.

Useful documentation may concern:

  • The electrical incident and where it occurred
  • The injury and resulting care
  • The worker’s employment and earnings
  • The equipment, power source, or worksite conditions involved

We prepare and review claim materials before submission, then communicate directly with insurers. Our goal is to resolve claims efficiently through calm, fair negotiation when possible. If a workers’ compensation dispute requires an appeal, we can represent the client before the Georgia State Board of Workers’ Compensation.

Spanish-speaking workers and families can receive bilingual support. We handle cases on a contingency fee basis, so clients don’t pay an attorney fee unless we win the case.

Understand Your Options After an Electrical Accident

Early guidance can clarify which deadlines apply, how medical-care rules affect the claim, and whether a responsible non-employer should be considered. If you have questions, contacting us doesn’t require you to move forward.

"The most humble person I have met in this profession and cares about the overall outcome."
I was injured in the apocalypse snow storm of Atlanta in 2014, I never intended or thought I would need an attorney to assist me with all the ongoing paperwork, needed to get me through this long and draining process. In the process I was not only drained of going to therapy 5 days a week 3 hours a day, groggy from pain pills, and really no in my right mind to make good decisions, I wanted this over and done with, but when I felt being pushed into the wrong direction by insurance company, I had no choice but to start my search I logged in on a Saturday and begin emailing attorneys to see if anyone could help me. On a Sunday Mr. Kaleita called we discussed the case not even being a client yet it was an immediate trust and connection, he understood my frustration and since that day I felt he has been a guardian angel to help me in every step of the way. Even when I thought we were completed, he was such a thorough person, he not only checked once but twice and always found something overall I feel he has become my greatest attorney yet, as well as a mutual friend..the most humble person I have met in this profession and cares about the overall outcome. I would recommend him to anyone. No matter what matter you may have he has a resource in the legal field to help you get your answers. Very knowledgeable in his field
