Personal Injury Attorney in Atlanta

30 Years Serving Atlanta Injury Victims. You Work With the Attorney, Not a Case Manager.

When you’re hurt in an accident, the attorney you call matters. At Kaleita Law Firm, LLC, we’ve represented injury victims in Atlanta and throughout North Georgia for over 30 years. Our clients work directly with the attorney on their case, not an assistant or case manager. Every call, every question, every update goes through the attorney. That level of access is rare in a high-volume legal market, and it makes a real difference in how cases are handled.

Our approach to insurance negotiations is cooperative and respectful rather than combative. Working constructively with insurance companies and their counsel can produce favorable outcomes, and our history of settlements reflects that. We handle personal injury and workers’ compensation matters for individuals and families throughout Atlanta, Sandy Springs, and the surrounding region. Free case evaluations are available, including video consultations and evening phone appointments.

If you or someone you love has been injured, contact our office today at (888) 665-7699 to schedule your free case evaluation.

Personal Injury Practice Areas

We handle the full range of personal injury cases that arise for Atlanta and North Georgia residents. If you’re identifying where your situation fits, the practice areas below cover the most common claim types we see.

Our personal injury practice areas include:

  • Car Accidents – Vehicle collisions are among the most common causes of serious injury in Georgia. Whether your crash involved a drunk driver, a distracted driver, a rear-end impact, a head-on collision, or a side-impact crash, eligible compensation can include medical bills, property damage, and lost wages.
  • Catastrophic InjuriesSpinal cord injuries, traumatic brain injuries, and severe burns carry permanent consequences for the victim’s life and livelihood. These claims require careful, long-term management from the start.
  • Motorcycle Accidents – Even a low-speed collision can produce permanent injuries for a motorcyclist, from severe abrasions and broken bones to lasting brain damage. These claims demand professional handling.
  • Premises Liability – Injuries on private, commercial, or government property are addressed through premises liability claims. All such properties carry insurance, and a case evaluation costs you nothing.
  • Truck Accidents – Commercial truck traffic between Atlanta and North Georgia runs heavily on highways 75, 85, 23, and connecting roads. Collisions involving commercial trucks frequently produce devastating injuries or fatalities.
  • Wrongful Death – When a loved one dies due to another’s negligence, certain close family members may file a wrongful death claim in Georgia. We help grieving families address the financial dimensions of their loss so they can focus on moving forward.
  • Workers’ Compensation – If you were injured during the course of your employment, you have the right to file a workers’ compensation claim. We work to have your claim submitted correctly and to pursue every available form of compensation on your behalf.

What You Can Recover in a Georgia Personal Injury Case

One of the first questions injured Georgians ask is what a personal injury claim can actually produce for them. The answer depends on the facts of your case, but the primary categories of compensable damages are consistent across most claims.

Most personal injury claims in Georgia can recover past and future medical expenses, lost wages and reduced earning capacity, property damage, and pain and suffering. In cases involving egregiously negligent or intentional conduct, including drunk driving, Georgia law permits punitive damages under O.C.G.A. 51-12-5.1, generally capped at $250,000 with exceptions that apply in DUI cases. Wrongful death claims can additionally seek compensation for the full value of the decedent’s life as well as estate expenses such as medical bills and funeral costs.

Georgia Filing Deadlines & the Comparative Negligence Rule

Georgia’s standard statute of limitations for personal injury claims is two years from the date of injury under O.C.G.A. 9-3-33. That window sounds long, but it moves quickly once you account for the time needed to gather evidence, document damages, and build a complete claim.

Government Entity Claims & Shorter Deadlines

Claims against government entities face tighter deadlines. A city requires ante litem notice within six months under O.C.G.A. 36-33-5, and a county requires notice within 12 months under O.C.G.A. 36-11-1. Both deadlines fall well inside the general two-year window, so early action matters even more when a government entity is involved.

How Georgia’s Comparative Negligence Rule Affects Your Claim

Georgia follows a modified comparative negligence rule under O.C.G.A. 51-12-33. A plaintiff found 50% or more at fault recovers nothing. A plaintiff found less than 50% at fault recovers a reduced award proportional to their share of fault. Insurance adjusters frequently try to push a victim’s share of fault above 50% to eliminate or reduce payment. Prompt legal counsel can be one of the most effective defenses against that strategy. Waiting to contact an attorney can allow critical evidence, including accident scene conditions, vehicle data, and surveillance footage, to be lost or overwritten. We work to have our clients’ claims filed correctly and within applicable deadlines.
